Traficom is the contact point in the pre-negotiation and brings together the project promoter and the authorities responsible for permit-granting decisions and administrative procedures.

 

Organising the preliminary negotiation of large TEN-T transport network projects

A preliminary consultation can be organised at the request of Traficom, another authority dealing with the matter or the project promoter. The pre-negotiation is carried out in cooperation with the responsible and key authorities of the project.

The aim of the pre-negotiation is to promote the overall management of the permit-granting and approval procedures required in the project, the exchange of information between the project promoter and the authorities, and to improve the quality and usability of reports and documents, and to streamline the procedures.

Notifying of major TEN-T transport network projects

The project promoter must inform Traficom about the project at the same time as it initiates the first permit-granting and approval procedure.

The notification shall contain a description of the project, a cost estimate of the project and information on completed and pending administrative procedures related to the project, as well as the permit-granting procedures required for the project.

Within four months of receiving the notification, Traficom will make a decision on the start of the deadline calculation or ask the project promoter to supplement the notification. Traficom will notify the competent authorities of the decision who, based on the notification, will participate in the processing of the project.

Calculating the deadline of a large TEN-T transport network project

The deadline starts from the date of arrival of the notification made by the project promoter about the project. The deadline ends when the last decision on the permit-granting and approval procedure is made.

The deadline does not include the time that elapses:

  1. when the applicant does not have a pending issue regarding the permit-granting and approval procedur
  2. completing an application, acceptance proposal or other document required for a procedure that falls within the scope of application at the request of a competent authority,
  3. in the handling of appeal cases concerning decisions concerning permit-granting and approval procedures.

The condition for leaving periods outside the deadline is that the applicant does not have other permit-granting and approval procedures referred to in the law (3 February 2023/138) pending. Traficom monitors the fulfilment of the deadline.

Extending the deadline and suspending the calculation of the deadline

The deadline can be extended at Traficom's initiative or at the request of the project promoter or the competent a thority for a justified reason to complete the permit-granting and approval procedures. The extension can be extended once for a justified reason.

Traficom can decide that the calculation of the deadline is suspended if the project promoter makes an application to that effect. Suspension of the calculation of the deadline is requested for a limited period.

Expiration of the calculation of the deadline

The decision to expire the calculation of the deadline can be made at the request of the project promoter or, if the permit-granting and approval procedure has been suspended for at least one year for a reason dependent on the project promoter.
