I want to become a bus or coach operator

Follow these steps

  • Step 1

    Set up a business

    If you have not set up a business yet, the business start-up wizard available on the Suomi.fi service is a great tool for setting one up. The service can be used by anyone to find out what you need to do and know when setting up a business. Based on the responses you give, the service will provide you with a checklist of matters that you need to consider.

  • Step 2

    Check the need for a licence

    A passenger transport licence is required for commercial transport of passengers by road using a vehicle referred to in the Vehicles Act as a bus or coach. The passenger transport licence is issued as a community transport licence, which entitles you to operate national transport in mainland Finland and to operate international transport in the EU Economic Area and Switzerland.

    However, no passenger transport licence is required to provide passenger transport services internally for a corporate group, a similar undertaking or a public corporation or to transport passengers as part of a municipality's or other public corporation's social and health care services, provided that certain conditions are met.

  • Step 3

    Make sure that you meet the licence conditions

    Before applying for a licence, it is recommended to register the applying business or undertaking in the Trade Register and the necessary Tax Administration registers.

    The licence conditions include professional competence, Business ID, legal capacity, good repute, being based in Finland and being able to demonstrate your financial standing and the appropriate fulfilment of obligations.

    Traficom does not assess in advance whether the conditions are met, nor does it issue preliminary decisions. The fulfilment of the conditions is only assessed during the processing of the licence application.

  • Step 4

    Acquire the professional competence required for operating as a bus and coach transport operator

    The applicant or the applicant’s transport manager must be professionally competent. Professional competence is achieved by completing the bus and coach transport operator examination. Read more: Road transport operator examination (in Finnish)

  • Step 5

    How to demonstrate financial standing

    The holder of a transport licence must at all times be able to meet their financial obligations in the course of the annual accounting year. To this end, the applicant must demonstrate that they have sufficient financial resources for the operations that they intend to engage in based on the licence, i.e. the applicant must demonstrate their financial standing. The applicant must demonstrate that they have at their disposal financial resources totalling at least EUR 9,000 when only one vehicle is used and EUR 5,000 for each additional vehicle used.

    Financial standing must be demonstrated taking into account all of the applicant’s transport licences, excluding taxi transport licences. In other words, the applicant must demonstrate that they have sufficient financial resources for all the goods and passenger transport licences that they currently posses or are applying for. The guarantee amount of EUR 9,000 for the first vehicle applies only once, not separately for both types of licences.

    Financial standing can be demonstrated with a certificate of the applicant’s financial resources issued by an authorised, meaning KHT, HT or JHT, auditor and/or a surety obligation (bank guarantee) issued by a credit, financing or insurance institution or a bank deposit (pledge account).

  • Step 6

    Apply for a transport licence for bus and coach services

    The licence is granted on the basis of an application. The licence can be granted either to a natural person who operates as a private trader (sole trader) or a legal person, such as a limited company or limited partnership.

    If the applicant is a legal person, they must have a transport manager. The transport manager must meet the licence conditions of good repute and professional competence and have a connection to the applying company.

    The application for a new licence, renewing an existing licence or additional licences must include a report on the applicant’s financial standing as an attachment. As regards the other licence conditions, the applicant must provide supplements or other evidence upon request. The application should be filled as thoroughly as possible, as requests for supplementary information will delay the granting of the licence.

    Applications will be processed in the order of arrival within approximately two weeks of the commencement of proceedings.

  • Step 7

    Information about passenger transport licences

    Only the party marked as the licence holder on the licence document can engage in transport operations based on the licence. If the licence holder is a natural person, only the person in question may engage in transport operations based on the licence, and they do so as a private trader (sole trader). If the licence holder is a community, only the community in question, such as a limited company or limited partnership, may engage in transport operations based on the licence.

    Transport licences cannot be transferred or forwarded to another party. For example, a licence granted to a natural person cannot be transferred to a company owned by the person; instead, the company must apply for a transport licence of their own.

    The applicant is granted a passenger transport licence and at least one copy of the passenger transport licence. The vehicle-specific copy of the passenger transport licence must be carried inside the vehicle whenever the vehicle is used for transport operations. The original licence must be stored at the licence holder’s place of business. The passenger transport licence is granted for 10 years.

    Vehicle-specific copies always expire at the same time with the original licence.

    A passenger transport licence also authorises the holder to transport goods using a bus or coach.

    You can update your telephone number and email address via My e-Services (My e-Services/Front page/My details). You can log in with your online banking credentials, mobile certificate or certificate card.

    You do not need to report a change of name or address to Traficom. Name or address changes for natural persons are reported to the Digital and Population Data Services Agency and name or address changes for legal persons are reported to the Finnish Trade Register.

Ensuring the competence of the bus or coach driver

The operator must ensure that the driver has valid licences for operating as a bus or coach driver.

A vehicle or vehicle combination used for transport operations requiring professional competence may only be handed over to a person whose professional competence has been verified based on either a separate professional competence card or a professional competence marking on their driving licence.

Opening of API data

Passenger transport licence holders must take into account the obligations imposed by the Act on Transport Services regarding the opening of API data. All API data must be submitted to the NAP service.

Company bus or coach services on electronic services

If the licence holder has an electronic service, such as a website, Facebook page or other comparable channel, they must provide the following information about their services via the channel:

  • information on whether the transport services are provided subject to a licence or if the service has been exempt from having a licence
  • the primary operating area, the services offered, including service times, any changes thereto and cancellations
  • prices or the basis for calculating the prices
  • the payment methods in use; passengers have the right to pay for their journey using cash and the most common payment cards, unless the available payment methods have been clearly specified on the electronic service and the passenger has specifically accepted them when making the order or reservation
  • services and assistance available for passengers with reduced mobility, accessibility of the vehicles and equipment that facilitates passengers in boarding the vehicle and interaction with the driver
  • instructions for providing customer feedback and procedures in case of errors.

If the licence holder does not have an electronic service, they do not need to set one up for the purpose of providing the above-mentioned information. However, in this case the information must be otherwise available in writing, such as in the form of printouts, or a dispatch centre can relay the information on the licence holder’s behalf.

Submission of demand and supply information

According to the Act on Transport Services, the Finnish Transport and Communications Agency shall monitor the demand for and supply of mobility services and coordinate their development. Passenger transport licence holders are obliged to submit supply and demand information to the Finnish Transport and Communications Agency Traficom for the performance of the aforementioned tasks and for statistical and research purposes.

The submitted information provides authorities with information on how the market is functioning. The submitted information is converted into a form from which individual licence holders can no longer be identified (anonymised). After this, the information can be distributed via an open API.

 

Vehicles that can be used for bus and coach services

A passenger transport licence authorises the holder to engage in the professional transport of passengers by bus and coach only. A bus or coach is defined as a vehicle that has at least nine passenger seats in addition to the driver’s seat.

Vehicle in operation subject to licence

The registered use information of a bus or coach used for the transport of passengers must be recorded as ‘operation subject to licence.’

Because of European Union legislation regarding transport licences and market access, the transport licence holder must be marked as at least the holder of the vehicle on the registration certificate.

The holder of a passenger transport licence shall also ensure that the registration number of the bus they use in traffic is attached to a transport licence and that this information is up-to-date in the Transport Register.

Vehicle use information can be changed by submitting a notification of the change at an inspection site providing vehicle registration services or via the vehicle’s insurance company. The notification can also be submitted via Traficom’s or the insurance company’s e-services in connection with a change of ownership, change of owner or holder information or the first registration of a vehicle for which an advance notification has been issued.

Taximeter

When a bus or coach is used for charter services, the bus or coach must be equipped with a taximeter in accordance with the Measuring Instruments Directive (2014/32/EU) if the price of the journey is based on the measurement of distance or time. A taximeter is not required if the journey is subject to a fixed price that the customer is notified of before the start of the journey. A taximeter is also not required when the bus or coach is used for market-driven or service agreement based service adhering to a specific route and timetable, the fare pricing of which is based on a pre-defined price list.

Taxi top light

A bus or coach cannot be used for taxi services, as a result of which equipping a bus with a taxi top light is prohibited. Because of this, a bus or coach also cannot use lanes or spaces designated exclusively for taxi services.

Permits for scheduled services and demand responsive transport permits

The Act on Transport Services does not include any provisions on permits for scheduled services or demand responsive transport permits. In practice, the aforementioned permits were discontinued as a result of the Act on Transport Services entering into effect. Passenger transport licence holders who provide services based on these permits or based on concession or other contracts should contact the competent ELY Centre about how to proceed.

International scheduled bus and coach services between EU Member States

The licences required for international scheduled passenger transport services between EU Member States are granted by Traficom.
