Market surveillance of road traffic

The purpose of market surveillance is to ensure that the devices and equipment being sold and imported are safe for people’s health, property and the environment, and that they will not pose a hazard when installed and used correctly.

Legislation, based on which Traficom carries out market surveillance:

  • Regulation (EU) 2018/858 of the European Parliament and of the Council on the approval and market surveillance of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles (Applied starting from 1 September 2020)
  • Regulation (EU) No 167/2013 of the European Parliament and of the Council on the approval and market surveillance of agricultural and forestry vehicles
  • Regulation (EU) No 168/2013 of the European Parliament and of the Council on the approval and market surveillance of two- or three-wheel vehicles and quadricycles
  • Regulation (EC) No 1222/2009 of the European Parliament and of the Council on the labelling of tyres with respect to fuel efficiency and other essential parameters
  • Regulation (EU) 2016/1628 on requirements relating to gaseous and particulate pollutant emission limits and type-approval for internal combustion engines for non-road mobile machinery
  • Act on the distribution of alternative fuels for transport (478/2017) (in Finnish)
  • Vehicles Act (82/2021)

Traficom monitors the safety of vehicles and vehicle parts and their compliance with the requirements. If you notice a defect in a vehicle or a part of a vehicle that poses a serious danger, or if the product does not comply with the requirements, you can submit a notification to Traficom. The notifications are used as a tool and an information channel for market surveillance.

Traficom monitors the following products, among other things:

  • Cars, busses, vans, trucks and their trailers
  • Mopeds, motorcycles and quadricycles
  • Tractors, motorised work machine and their trailers
  • Different parts, systems and equipment of vehicles, such as lamps and tyres
  • Safety equipments used on road, such as helmets and child safety seats
  • Bicycles
  • Light electric vehicles, such as e-scooters
  • Light automatic goods transporters
  • Snowmobiles
  • Other products within the scope of application of the Vehicles Act (1090/2002)

Do as follows:

  1. You should primarily contact the product manufacturer, the manufacturer’s representative, the importer or the dealer.

If you notice a defect in the product that has caused a serious danger or if you notice that the product does not comply with the requirements, you should primarily contact the product manufacturer, the manufacturer’s representative, the importer or the dealer and try to resolve the matter with them. This is important because in this way, the manufacturer also receives information on products that are hazardous or do not comply with the requirements. 

  1. Check if the product you reported is included in the product groups monitored by Traficom

Before submitting a notification, check if the product you reported is included in the product groups monitored by Traficom. If you submit a notification on a product that is not within the scope of Traficom’s market surveillance, we will transfer it to be processed by the competent authority and also notify you about this.  Please fill in the form as accurately as possible; if possible, also include images so that we can get a comprehensive idea of the situation.

         

 

      4.Traficom always assesses dangerous situations described in the notification on a case-by-case basis

Traficom always assesses dangerous situations and other matters related to non-compliance described in the notification. In scenarios that pose a hazard, the risk assessment tool created by the European Commission is used, among other things. With regard to products that pose a hazard, the aim is to assess the risk to consumers by using sales volumes and the number of similar cases as well as the severity of the scenario that took place, among other things. If necessary, Traficom will contact the party that submitted the notification to obtain further information.

Please note that Traficom cannot comment on matters related to compensation. If an agreement with the operator concerning compensation or a civil case cannot be reached, the Finnish Competition and Consumer Authority (FCCA), for instance, can help with the matter.
