AI regulatory sandbox

Traficom helps organisations take the requirements of the EU Artificial Intelligence Act (AI Act) into account as early as possible, so they can build compliance into their AI systems from the start of product development.

Develop your AI system in compliance with the AI Act

The AI regulatory sandbox is a service coordinated by Traficom. It allows providers of AI systems to receive guidance and support from authorities on how to meet the requirements of the AI Act while their systems are still being developed.

The sandbox aims to promote the development of trustworthy and safe AI systems and help organisations identify their obligations under the AI Act before placing their systems on the market.

Who is the service for?

The regulatory sandbox is intended for organisations developing AI systems that have not yet been placed on the market or are undergoing substantial modifications.

The service is particularly suitable for providers of AI systems who want to address regulatory questions concerning their systems before placing them on the market, including:

  • start-ups
  • small and medium-sized enterprises (SMEs)
  • research and development organisations

Participation in the regulatory sandbox is voluntary. Organisations are selected based on the selection criteria laid down in the AI Act and national legislation.

What does the service include?

The regulatory sandbox provides organisations with support, particularly in understanding how the AI Act applies to their systems and how to meet its requirements.

The service may include:

  • guidance on applying the AI Act
  • support in assessing the risk classification of an AI system
  • identifying the regulatory requirements applicable to the system
  • reviewing technical documentation
  • discussions with authorities
  • technical testing where necessary, appropriate and feasible

Not all systems require technical testing. In many cases, reviewing documentation and discussing regulatory questions with authorities provide a sufficient basis for taking the requirements of the AI Act into account during development.

What is the regulatory sandbox not intended for?

The regulatory sandbox does not provide:

  • conformity assessments
  • certification
  • market access testing
  • consultancy services

The provider of an AI system always remains responsible for ensuring that the system complies with the applicable requirements.

The role of the authorities is to provide guidance and support on regulatory questions and promote a shared understanding of the requirements of the AI Act.
